Terms of Service Agreement

1. Introduction
This Terms of Service Agreement (“Agreement”) is made between Bubble Media Group, Trading as DC Media (“Photographer/Videographer”) and the client (“Client”). By booking photography and/or videography services with Bubble Media Group, Trading as DC Media, the Client agrees to the terms set out in this Agreement.

2. Client Responsibilities

  • The Client must obtain all necessary permissions, permits, and consents for the location and individuals featured in the photography/videography. Bubble Media Group, Trading as DC Media is not responsible for any legal issues arising from a failure to obtain proper consent.
  • The Client agrees to cover all reasonable expenses incurred during the shoot, including but not limited to travel, accommodation, and location fees.
  • The Client acknowledges that they have reviewed Bubble Media Group, Trading as DC Media’s portfolio and are satisfied with the style and quality of work.
  • The Client waives any right to hold Bubble Media Group, Trading as DC Media liable for dissatisfaction based on artistic interpretation.

3. Photographer Responsibilities

  • Bubble Media Group, Trading as DC Media will provide professional-grade equipment and skilled personnel for the agreed-upon services.
  • The Photographer/Videographer and their team will conduct themselves professionally and respectfully throughout the duration of the service.
  • In the event of staff unavailability, Bubble Media Group, Trading as DC Media reserves the right to provide a suitable replacement.

4. Artistic Release

  • The Client acknowledges that photography and videography are artistic services, and final results may vary based on creative judgment.
  • Edits and adjustments will be made in line with Bubble Media Group, Trading as DC Media’s established style. No additional alterations will be made upon delivery.
  • RAW files will not be provided under any circumstances.
  • The Client is not permitted to alter or edit the final images/videos, including but not limited to filters and color adjustments.
  • Turnaround times will be as agreed, with no guarantees of expedited delivery unless otherwise agreed in writing.

5. Term and Termination

  • Any cancellations made by the Client will result in forfeiture of any deposits or fees paid.
  • Rescheduling requests are subject to availability and may incur additional charges.
  • No refunds will be issued once a booking is confirmed.
  • No photos or videos will be released until full payment has been received.
  • If the Client or key individuals are late to the shoot, this time will be deducted from the scheduled session, and no additional time will be provided.
  • If Bubble Media Group, Trading as DC Media is unable to fulfill the booking due to unforeseen circumstances, a full refund will be issued, or a replacement photographer/videographer will be arranged where possible.

6. Ownership and Usage Rights

  • Bubble Media Group, Trading as DC Media retains full ownership, including copyright, of all images and video footage captured.
  • The Client is granted a limited, non-transferable license to use the final images and videos for commercial purposes as agreed upon.
  • The Client may not sell, edit, or distribute the work beyond the agreed-upon usage without prior written permission.
  • Bubble Media Group, Trading as DC Media reserves the right to use any images or video footage for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.

7. Indemnity and Limitation of Liability

  • The Client agrees to indemnify and hold harmless Bubble Media Group, Trading as DC Media and its employees from any claims, damages, or liabilities arising from the use of images/videos.
  • Bubble Media Group, Trading as DC Media will not be held liable for circumstances beyond its control, including but not limited to weather conditions, accidents, equipment failure, or loss of data.
  • In the event of data loss prior to the content being supplied, Bubble Media Group, Trading as DC Media’s liability is limited to a refund of the service fee.

8. General Terms

  • This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.
  • Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts in the United Kingdom.
  • This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements.
  • No amendments or modifications shall be valid unless agreed to in writing by both parties.

9. Acknowledgment
By booking services with Bubble Media Group, Trading as DC Media, the Client acknowledges that they have read, understood, and agreed to the terms outlined in this Agreement.
